Terms & Conditions

Pixie Kitchen Ltd – Terms & Conditions

1. Bookings

A booking is confirmed only when the required deposit has been received and written confirmation has been issued by Pixie Kitchen Ltd ("Pixie Kitchen").

The deposit is non-refundable and secures the event date. No date shall be reserved until the deposit has been received.

2. Payments

Payment schedules will be detailed within the quotation, invoice or booking confirmation provided by Pixie Kitchen.

Unless otherwise agreed in writing:

  • The booking deposit is payable upon confirmation.
  • Any interim payments must be made by the dates specified on the relevant invoice.
  • The final balance must be paid before the event date.

Pixie Kitchen reserves the right to suspend or cancel services where payment is not received by the agreed deadlines.

All payments must be made by bank transfer unless otherwise agreed in writing.

3. Menu Changes and Additional Services

Requests for menu amendments, dietary additions, guest number increases, staffing changes, equipment hire, bar services or other additional services must be submitted in writing.

Requests should be made no later than 60 days before the event date.

Additional services and menu changes may incur additional charges and are not confirmed until accepted in writing by both parties.

Pixie Kitchen will make reasonable efforts to accommodate changes requested after this deadline but cannot guarantee availability.

4. Final Guest Numbers

Final guest numbers must be confirmed in writing no later than 14 days before the event date.

This confirmed number will be used for staffing, food ordering, equipment hire and invoicing purposes.

Reductions in guest numbers made after this deadline may not result in a reduction of the booking price.

Requests to increase guest numbers after the final confirmation deadline will be accommodated where reasonably possible but cannot be guaranteed and may incur additional charges.

5. Ingredient Availability

Pixie Kitchen will make every reasonable effort to provide the agreed menu.

Where ingredients become unavailable due to supplier shortages, seasonal availability or circumstances beyond our control, suitable alternatives may be substituted.

Where practical, clients will be notified of any substitutions in advance.

6. Venue Access and Event Logistics

The client is responsible for ensuring that Pixie Kitchen has sufficient access to the venue for setup, service and collection of equipment.

Any costs associated with venue access, permits, parking, utility usage, setup periods or breakdown periods shall be the responsibility of the client unless otherwise agreed.

The client must ensure that decorations, furniture, floristry, staging or other installations do not obstruct catering operations or food service areas.

Where necessary, the client shall provide contact details for venue staff, planners, stylists or other suppliers involved in the event.

7. Equipment, Hire Items and Damage

All crockery, cutlery, glassware, serving equipment, furniture, linens and hire items supplied by Pixie Kitchen remain our property unless otherwise stated.

The client shall be responsible for any loss, theft, damage or breakage caused by guests, venue staff, contractors or other persons attending or working at the event.

Replacement or repair costs may be invoiced following the event and shall be payable within 14 days.

8. Allergies and Dietary Requirements

The client must provide details of all known allergies and dietary requirements no later than 30 days before the event.

While every reasonable precaution is taken during food preparation and service, food is prepared in environments where allergens are present and cross-contamination cannot be completely eliminated.

Pixie Kitchen shall not be liable for reactions resulting from undisclosed allergies, dietary requirements or the inherent risks associated with food preparation and service.

9. Leftover Food

Due to food safety regulations, Pixie Kitchen reserves the right to remove any remaining food from the venue at the conclusion of service.

Where agreed in advance, certain suitable items such as cakes, brownies, baked goods or unopened products may be left with the client.

Responsibility for the safe storage, transportation, handling and consumption of any food retained by the client passes to the client upon collection or handover.

Pixie Kitchen accepts no liability for illness, injury, loss or damage arising from food consumed after handover to the client or after recommended food safety time limits have expired.

10. Bar Services

Where bar services are provided, Pixie Kitchen reserves the right to refuse service to any person who appears intoxicated, abusive, underage or whose behaviour may present a risk to themselves or others.

Where alcohol is supplied by the client, the client remains responsible for ensuring compliance with all applicable licensing laws and venue requirements.

Pixie Kitchen operates a Challenge 25 policy where required by law and reserves the right to request valid proof of age before serving alcohol.

11. Cancellation by the Client

All cancellations must be made in writing.

Cancellation charges are as follows:

  • More than 120 days before the event date: deposit retained.
  • 60–119 days before the event date: 30% of the total booking value payable.
  • 30–59 days before the event date: 50% of the total booking value payable.
  • 21–29 days before the event date: 70% of the total booking value payable.
  • Less than 21 days before the event date: 100% of the total booking value payable.

Any unpaid cancellation fees remain payable by the client.

12. Cancellation by Pixie Kitchen

In the unlikely event that Pixie Kitchen is unable to fulfil a confirmed booking, the client will be notified as soon as reasonably possible.

Any payments received for services that cannot be provided will be refunded in full.

13. Photography and Marketing

Pixie Kitchen may photograph or film food, styling, service areas and event setups for use on its website, social media channels, portfolio and marketing materials.

Pixie Kitchen will not publish personal information relating to clients without prior consent.

Clients who do not wish photographs of their event to be used for marketing purposes must notify Pixie Kitchen in writing prior to the event.

14. Health and Safety

Pixie Kitchen operates in accordance with all applicable food hygiene, food safety and health and safety legislation.

The client is responsible for ensuring that the venue complies with any legal requirements applicable to the event.

15. Limitation of Liability

Pixie Kitchen maintains appropriate public liability insurance.

Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability which cannot legally be excluded under English law.

Subject to the above, Pixie Kitchen's total liability arising from any booking, whether in contract, negligence or otherwise, shall not exceed the total amount paid by the client for the services provided.

Pixie Kitchen shall not be liable for any indirect, consequential or economic loss including loss of enjoyment, loss of profit or loss of opportunity.

16. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations where such failure or delay arises from circumstances beyond reasonable control.

Such circumstances include but are not limited to severe weather, flooding, fire, natural disasters, pandemics, government restrictions, terrorism, industrial disputes, utility failures or supplier failures.

Where a force majeure event occurs, both parties will work together in good faith to explore alternative arrangements where possible.

17. Governing Law

These Terms and Conditions and any dispute arising from them shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

19. Acceptance

Payment of a deposit, acceptance of a quotation, written confirmation of a booking, or receipt of catering services shall constitute acceptance of these Terms and Conditions.
